These Terms & Conditions ("Terms") are a legal agreement between you and Contact Me LLC ("Contact Me," "we," "us," or "our"). They govern your use of the Contact Me mobile application (the "App") and our website at contactme-hq.com (together, the "Services"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. What Contact Me Is, and Is Not
Contact Me lets you send urgent sound alerts to trusted contacts, receive alerts that stand out, control who can alert you, create group chats, and manage alert settings such as quiet time and volume.
Contact Me is not an emergency service. The App does not connect you to 911 or any other emergency, police, fire, or medical service, and it must never be used as a substitute for one. Alert delivery depends on factors outside our control, including network coverage, device settings, battery, and whether the recipient's device is on. We do not guarantee that any alert will be delivered, that the recipient will see or hear it, or that the recipient will respond, answer, or call back. In any emergency, always call your local emergency number first.
2. Your Account
- You register by signing in with your Google account or Apple account, which is also how your account is verified. If you provide a phone number, we may send you text messages related to the Services.
- You are responsible for the activity that happens under your account and for keeping your device and sign-in credentials secure.
- You agree to provide accurate information and keep it up to date.
- Notify us promptly at the contact email below if you believe your account has been accessed without your permission.
3. Trusted Contacts and Consent
When you add someone as a trusted contact, you confirm that you have their permission to add them and to share their name and phone number with us. You may only send alerts to people who have agreed to receive them through the App. Recipients control who can alert them and may remove you at any time.
4. Acceptable Use
You agree not to:
- Use alerts to harass, threaten, spam, or repeatedly disturb another person;
- Send false alarms or misuse urgent alerts for non-urgent matters in a way that harms others;
- Impersonate any person or misrepresent your identity;
- Upload content that is unlawful, abusive, hateful, sexually explicit, or infringes anyone's rights;
- Attempt to hack, reverse engineer, disrupt, or gain unauthorized access to the Services;
- Use the Services for any unlawful purpose or in violation of any applicable law.
We may suspend or terminate accounts that violate these rules. If you are a minor, you should use the Services with the knowledge and consent of a parent or guardian.
5. Your Content
You keep ownership of the photos, videos, and messages you share through the App ("User Content"). By sharing User Content, you grant us a limited, non-exclusive, royalty-free license to host, store, and transmit it solely to operate and provide the Services. You are responsible for your User Content and confirm you have the rights needed to share it.
6. Subscriptions and Purchases
- Some features require a paid subscription, offered on monthly and annual plans. Current pricing is shown in the App and on the App Store before you purchase.
- Subscriptions are billed through your Apple App Store account and renew automatically unless you cancel at least 24 hours before the end of the current billing period.
- You can manage or cancel your subscription anytime in your device's App Store subscription settings. Deleting the App does not cancel a subscription.
- Payments and refunds are handled by Apple under its terms. Except where required by law, purchases are non-refundable through us, and refund requests go through Apple.
- We may change subscription features or pricing going forward; changes will not affect a billing period you have already paid for.
7. Intellectual Property
The Services, including the App, design, logos, and all content we provide, are owned by Contact Me LLC and protected by intellectual property laws. We grant you a personal, limited, non-transferable, revocable license to use the App on Apple-branded devices you own or control, for your personal, non-commercial use, in line with these Terms and the App Store's usage rules.
8. Third-Party Services
The Services rely on third parties such as Apple (distribution, sign-in, and push notifications), Google (sign-in), telecom carriers (SMS and calls), and hosting providers. We are not responsible for the acts, omissions, or availability of third-party services, including your carrier's message and data rates.
9. Termination
You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Services. Sections that by their nature should survive termination (including Sections 10 through 13) will survive.
10. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free, or that any alert will be delivered, noticed, or responded to. Your use of the Services is at your own risk.
11. Limitation of Liability
To the maximum extent permitted by law, Contact Me LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the Services, including any failed, delayed, unnoticed, or unanswered alert. To the maximum extent permitted by law, our total liability for any claim relating to the Services will not exceed the amount you paid us in the twelve (12) months before the claim arose, or one hundred U.S. dollars ($100) if you have paid nothing. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Contact Me LLC from claims, damages, and expenses (including reasonable attorneys' fees) arising from your User Content, your misuse of the Services, or your violation of these Terms or any law.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Michigan, and you consent to their jurisdiction. Nothing in this section limits any rights you may have under the consumer protection laws of your place of residence.
14. Apple App Store Terms
These Terms are between you and Contact Me LLC only, not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content and has no obligation to provide maintenance or support for it. To the extent required, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the App must also comply with the App Store Terms of Service.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means and update the effective date above. Continuing to use the Services after changes take effect means you accept the updated Terms.
